This is an appeal under Section 374(2) Cr.P.C. against judgment and order dated 14.08.1986 passed by Vth Additional District Judge, Moradabad in Sessions Trial No. 231 of 1983 (State vs Shiv Lal and Another) convicting and sentencing the appellant herein to undergo rigorous imprisonment for one year under Section 452 IPC and further sentencing him to undergo rigorous imprisonment for three years under Sections 307/34 IPC. Both the sentences will run concurrently. 2. There is an office report dated 03.09.2025, which reads as under:- "In compliance of Hon'ble Court's order dated 31/07/2025, a letter (at flag 'B') has been received from CJM, Moradabad, wherein it is reported appellant died about 13-14 years ago, members of his family reside somewhere in Chandigarh. Relevant statements are enclosed. The case is put up for orders." 3. Office report dated 03.09.2025 refers to a report of Chief Judicial Magistrate, Moradabad , according to which, the appellant-Hardwari S/o Ganga Ram has expired 13-14 years ago. The supporting documents are available on record. 4. Since, appellant-Hardwari S/o Ganga Ram has expired, thus the appeal Versus Counsel for Appellant(s) : K. Sahai Counsel for Respondent(s) : A.G.A.
