01. After brief submissions, learned counsel for the petitioner seeks to withdraw the present petition with liberty to approach the competent appellate Court to assail order dated 19.12.2024, passed by learned Sub-Judge/Special Mobile Magistrate, Jammu in an application under Order XXXIX Rule 1 CPC.
02. In view of the above, the present petition is dismissed as withdrawn with liberty prayer for. However, order dated 21.12.2024, passed by this Court shall remain in operation for a period of ten days, sought by learned counsel for the petitioner to file appeal.
