PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/ Accused No.9 on bail in Crime No.153 of 2025 of Ulindakonda Police Station, Kurnool District registered against the Petitioner/ Accused No.9 herein for the offences punishable under Section 395 of Indian Penal Code (for short ‘the IPC’). 2 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. 3. Mr. V. Nitesh, learned counsel for the petitioner, submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is the sole breadwinner of his family and is willing to abide by any conditions that may be imposed by this Court while granting him bail. The petitioner was arrested on execution of P.T. warrant on 07.05.2025. The investigation in this crime has been completed and a charge sheet has been filed. Hence, it is prayed that bail be granted to the petitioner. 4. Per contra, Ms. P. Akila Naidu, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner. She submits that the petitioner, along with nine other accused persons, robbed L.W.1's courier lorry, which was loaded with valuable cell phones worth approximately Rs.5,00,000/-. Accused Nos.1 to 3 were arrested, and the investigation was completed and charge sheet filed against them. The charge sheet also shows that the remaining accused including the petitioner are absconding, and the investigation is pending against the petitioner and the other accused. Hence, the learned Assistant Public Prosecutor prays for dismissal of the criminal petition. 5. According to the prosecution, on 28.11.2019, L.W.2, the driver of the courier lorry transporting goods from Bangalore to Hyderabad, was travelling 3 near Veldurthy and had reached Ulindakonda on Highway No.44. At that point, the petitioner and nine others stopped the lorry on the highway. The petitioner and other accused forcibly entered the cabin of the container lorry, forced L.W.2 to get down, and threatened him by holding a knife to his neck. Thereafter, accused Nos.1 to 3 and seven others, armed with lethal weapons, broke the back door of the container lorry with a cutter, opened it, cut open the parcel bags, and decamped with stolen property worth Rs.5,00,000/-. 6. After a thorough investigation regarding the role played by accused Nos.1 to 3, the police filed a charge sheet, showing the other accused, including the petitioner, as absconding. The petitioner was arrested on execution of P.T. warrant on 07.05.2025 and has been in judicial custody since then. Two adverse antecedents have been reported against him. The investigation regarding the role allegedly played by the petitioner is still pending. The test identification procedure of the petitioner by L.W.2 is also yet to be conducted. The investigation is at a progressive stage. 7. Considering the gravity and nature of the allegations, as well as the facts and circumstances of the case, this Court is not inclined to enlarge the Petitioner/Accused No.9 on bail at this stage. 8.
