1. The applicant/petitioner was granted anticipatory bail by an
order dated January 7, 2025, passed by a Division Bench of this Court, in CRM (A) 953 of 2024, inter alia, on the condition that he shall “meet the Investigating Officer of the case every week until further orders.”
2. The applicant/petitioner now seeks waiver of this condition. He says that he has been complying with the condition. Charge-sheet has been filed upon completion of investigation. It is not necessary for him to report to the Investigating Officer every week.
3. The applicant/petitioner further produces copy of an order dated March 6, 2025, passed in IA No: CRAN/1/2025 in CRM
2 (A) 789 of 2024, whereby a similar condition imposed while granting anticipatory bail to a co-accused person was waived.
4. Learned State Advocate says that no report as called for by my earlier order dated April 4, 2025, is available.
5. However, I find from the annexures to the present application that the applicant/petitioner has been reporting to the Investigating Officer in terms of the order granting him anticipatory bail. Since charge-sheet has been filed, I am inclined to waive that condition and I accordingly do so.
6. However, the applicant/petitioner shall attend each and every date of hearing before the learned Trial Court. Even if on one occasion he fails to do so without justifiable cause, the learned Trial Court will be entitled to cancel the anticipatory bail of the applicant/petitioner without further reference to this Court.
7. The other conditions of bail shall remain unaltered.
8. The application being IA No: CRAN/2/2025 is accordingly
disposed of.
