...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order, or Direction more particularly one in the nature of WRIT OF MANDAMUS or any other appropriate writ or direction declaring the action of the respondents in not finalizing bills and not preparing the bills towards final bills for the works executed by the Petitioners i.e., Completion of Incomplete CPWS Scheme to Seethampeta and other Habitations of Seethampeta Mandal of Srikaikulam District (now in Parvathipuram Manyam District) as illegal, arbitrary and violative of Art 14 and 21 of Constitution of India and consequently direct the respondents to prepare and finalize the bills for the works executed by the petitioners and to pay the entire finalization of bill amounts in respect of execution of above-mentioned work forthwith and pass such IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct respondents to prepare and finalize the bills for the works executed by the Petitioners and record the same as Pass order in Measurement Book forthwith for the works executed and completed by the Petitioners i.e.,
Completion of Incomplete CPWS Scheme to Seethampeta and other Habitations of Seethampeta Mandal of Srikakulam District (now in Parvathipuram Manyam District) pending disposal of the main Writ Petition and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to permit to receive the counter affidavit by allowing the leave petition in the interest of justice and to pass Counsel for the Petitioner(S):

ORDER:
Non payment of bills for the works executed by the petitioner for completion of incomplete CPWS scheme to Seethampeta and other Habitations of Seethampeta Mandal, Srikakulam District, is the grievance of the petitioners.
2. Heard Sri Rambabu Koppineedi, learned counsel for the petitioners and Smt.Naga Chandrika, learned Assistant Government Pleader for Panchayat Raj for the respondents.
3. Smt.Naga Chandrika, learned Assistant Government Pleader for the respondents on instructions submitted that the bills which are now claimed by the petitioners are admitted by the respondents and they are ready and willing
to process the same and pay the amounts, however, sought five months time for such payment.
4. To the said submission, learned counsel for the petitioners reported no objection.
5. Taking into consideration, the submissions of both the learned counsel, as the authorities are ready to pay the net amount to the petitioners, this Court is inclined to dispose of the Writ Petition at admission stage.
6. Accordingly, the Writ Petition is disposed of. The respondents are
directed to release the admitted/legally entitled amount to the petitioner at the earliest and at any rate, within a period of five (05) months from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel, miscellaneous applications, pending if any, shall stand closed. _____________________________
