ORDER:
This Writ Petition under Article 226 of the Constitution of India is filed by the Petitioner seeking the following relief:
“...to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents 2 to 4 in not conducting fair investigation by considering petitioner's request to record the statements of the witness in Cr.No.166 of 2021 under section 161 of Cr.P.C. video graphic mode and also constitution of Special Investigation Team (SIT) for fair and proper investigation of case as illegal, irregular, arbitrary and unjust, violation of the provisions of the Criminal procedure Code and also offends Articles 14 and 21 of Constitution of India and consequently direct the Respondent No.2 to monitor the investigation in Cr.No.166 of 2021 by constituting the Special Investigation Team (SIT) and pass ....”
At the time of hearing, learned counsel for the Petitioner would submit that the cause does not survive for adjudication and this Writ Petition has become infructuous. Learned Assistant Government Pleader for Home appearing for respondent State is in attendance. In that view, this Writ Petition is dismissed as infructuous. No order as to costs.
