APHC010556442025 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI CONTEMPT CASE NO: 3136 of 2025 Bench Sr.No:-32 [3506] A.S.R. Somayajulu ...Petitioner Vs. Ramesh Krishnamurthi and Others ...Contemnor(s) ********** Advocate for Petitioner: Sri K. GANI REDDY Advocate(s) for Contemnor(s): Sri T. BALAJI (SC FOR EPFO), CORAM : SRI JUSTICE CHALLA GUNARANJAN DATE : 19th December 2025 JUDGMENT: On 12.12.2025, this Court passed the following order. “None appears for the petitioner. Learned counsel for the respondents is present and submits that the orders of this Court are complied with. The petitioner has been found eligible for pension on higher wages and as such, the demand notice has already been issued to the employer of the petitioner for payment of differential contribution and on receipt of the said amount, the higher pension would be processed in favour of the writ petitioner. List this matter next week.” 2. Learned counsel for the petitioner submits that the petitioner is entitled for pension on higher wages as claimed and as the same was not settled by the respondents, their inaction has been challenged in the writ petition and that by order, dated 25.04.2025, in W.P.No.9063 of 2 2025, direction was given to the respondents 2 to 4 to consider the representation and pass appropriate orders, however, they have not settled the pension, considering the higher wages. 3. Learned counsel for the respondents, on the other hand, submits that petitioner has now been found to be eligible for higher wages so also for higher pension and that notice has been issued to his employer for payment of the employer’s contribution and once petitioner also makes matching contribution in terms of the Employees Pension Scheme, 1995, pension would be re-billed and paid. 4. In that view of the matter, as already necessary steps have been taken for compliance of the directions of this Court, the Contempt Case stands closed. No order as to costs. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________________________ JUSTICE CHALLA GUNARANJAN Date:19.12.2025. cs
