1. By way of the present petition, the petitioner is praying for the following reliefs:
“10.1 Issue writ/order/direction quashing the impugned order dated 17.06.2025 (Annexure P/1) passed by the Office of Ld. Collector, (Revenue), Kanker, District North Bastar, Kanker (C.G.). 10.2 Issue writ/order/direction restricting respondents to take any action in relation to the subject land in dispute without giving proper opportunity of hearing to the petitioner. 10.3 Any other writ/order/relief in favour of the petitioner, which the Hon’ble Court deemed fit and just in the facts and circumstances of the case, including awarding of the costs to the petitioner.”
2. Learned counsel for the petitioner submits that Sarpanch of Village Kottra filed application for demarcation of land bearing khasra no. 1327, 1328, 1329, 1330 situated at Village Kottra P.H. No. 17 R.N.M. Lakhanpuri Tehsil Charama District- North Bastar
3 Kanker C.G. on which demarcation was conducted on 12.03.2025 without giving any opportunity of hearing to the petitioner despite the undisputed facts that the name of the petitioner is being reflected in revenue records as Bhumiswami.
3. Learned State counsel submits that there is an alternate remedy available to the petitioner under Section 44 of the CGLRC, 1959.
4. I have heard learned counsel for the respective parties and perused the record with utmost circumspection.
5. Looking to the entire facts and circumstances of the case,
submissions of the counsels, since an alternate remedy is available to the petitioner under Section 44 of C.G. Land Revenue Code, 1959, therefore, there is no good ground to entertain this petition. The petitioner may file an appeal under Section 44 of C.G. Land Revenue Code, 1959, if so desire.
6. In view of the above, the present petition is disposed of. Sd/-
