Upon consideration of the averments made in the restoration application, I am of the view that the petitioners have sufficiently explained the reasons for their non-appearance before this Court on January 6, 2025. Accordingly, CAN 1 of 2025 is allowed, and the writ petition is restored to its original file and number. In Re: WPA 2493 of 2024 Petitioner No. 1, Tea Company, alleges that despite repeated complaints regarding the theft of tea 2 leaves from the tea garden Karma Hi-Tech and Agro Private Limited, located in Machuadhura village, P.S. Malbazar, Jalpaiguri, the police have failed to take appropriate action. Conversely, the learned advocate appearing for the State submits that, pursuant to the complaints filed by the petitioners, Malbazar Police Station has already registered FIR No. 572 of 2024, dated October 1, 2024, under Sections 303(2) and 3(5) of the Bharatiya Nagarik Sanhita, 2023. In view of the foregoing, no further adjudication is required in this writ petition. Accordingly, this writ petition is disposed of with a direction to the Officer-in-Charge of Malbazar Police Station to expedite the investigation and take necessary action against the delinquent persons. Consequently, WPA 2493 of 2024 stands disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
