... Petitioner versus State Of Chhattisgarh Through- Station House Officer, Police Station- Sarkanda, District- Bilaspur (C.G.)
---- Respondents For Petitioner : Ms. Maya Chaturvijani, Advocate. For Respondent/State : Ms. Ankita Shukla, Panel Lawyer. Hon'ble Shri
Ramesh Sinha
, Chief Justice
Order on Board 05.05.2025
1. Heard Ms. Maya Chaturvijani, learned counsel appearing for the petitioner. Also heard Ms. Ankita Shukla, learned Panel Lawyer for the respondent/State.
2. The petitioner has filed the instant petition under Section 528 of BNSS being aggrieved by the order dated 22.03.2025 passed in Special Session Case (NDPS) No. 158/2023 passed by the learned Special Judge (NDPS), Bilaspur, District – Bilaspur (C.G.), whereby the learned trial Court has rejected the application filed by the applicant/petitioner under Section 127 of PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.05.07 11:06:25 +0530
2 the Bharatiya Sakshya Adhiniyam, 2023.
3. The prosecution story, in short, is that on information of the informant on 18.10.2023, a total of 10 Kg 100 Gms Ganja has been seized from the possession of the petitioner at the place of incident near Chhatghat, and offence under Section 20(b) of the NDPS Act has been registered against the applicant. The Police of Police Station Sarkanda, District Bilaspur (C.G.) registered the FIR bearing Crime No. 1403/2023 for the offence punishable under Section 20(b) of the NDPS Act. Charge-sheet has been submitted on 11.12.2023 before the trial Court, and the case is pending before learned Special Judge (NDPS), Bilaspur, District – Bilaspur (C.G.), in Special Sessions Case (NDPS) No. 158/2023.
4. The applicant/petitioner filed an application under Section 127 of the Bharatiya Sakshya Adhiniyam, 2023 for cross-examination of Judicial Magistrate First Class, Bilaspur, District – Bilaspur (C.G.), which has been rejected by learned trial Court without properly appreciating the material available on record. Hence, this petition.
5.
Learned counsel appearing for the petitioners submits that the learned trial Court wrongly rejected the application as the Police Station – Sarkanda produced the illicit contraband on 19.10.2013 but the learned Chief Judicial Magistrate directed the Investigating Officer to produce illicit contraband for physical verification on 20.09.2023 in his own writing with signature and stamp. The huge differences regarding date in the document which has been
3 exhibited as Ex. P-63, it means the Investigating officer produced illicit contraband to Chief Judicial Magistrate in question. Secondary, there is not list of seized articles made by Investigating Officer which is necessary as per the provisions of Rule 22 of the NDPS Act. It is further submitted that as per the document exhibited as Ex.P-31, Para-1 says that seized article was not produced before the Magistrate which is kept in the Malkhana as per the document says. Another important question raised in application dated 22.03.2025, in Para-3 (क, ख,
ग और घ) which reads as under:

It is further submitted by learned counsel for the petitioner that the learned trial Court erred in rejecting the application and in his order stated that only produce of illicit article before the Chief Judicial Magistrate is sufficient to comply the section 52A of NDPS Act. The questioned document Ex.P-63 and Ex.P-31 is not in question without any justifying error made by the concerned Investigating Officer. The learned Chief Judicial Magistrate verified the documents and the trial Court stated that this is sufficient compliance of Section 52A of NDPS Act and the primary evidence is laid down against the present applicant. 7. Learned State counsel opposes the submissions advanced by the
5
learned counsel for the petitioner and supports the order of the trial Court dated 22.03.2025 rejecting the application filed by the petitioner under Section 127 of the Bharatiya Sakshya Adhiniyam, 2023, and submits that in the present case, on the basis of an application submitted by the SHO Sarkanda for physical verification of seized Ganja in Crime No. 1403/2023, Section 20(B) of the NDPS Act registered at Police Station – Sarkanda, Bilaspur, learned JMFC, District – Bilaspur, has given certificate of Section 52A (3) of the NDPS Act by certifying the panchnama and photographs and according to Sub-section 4 of Section 52A of the NDPS Act, and the list of photographs and samples of narcotic drugs, psychotropic substances or transports certified by the JMFC, should be considered as prima facie evidence in relation to such crime by the learned trial Court, hence there is no need to summon JMFC concerned for evidence in this regard, therefore, the instant petition being devoid of merits is liable to be dismissed. 8. I have heard learned counsel for the parties and perused the materials available on record. 9. Considering the submissions advanced by the learned counsel for the parties, and from the perusal of the judgments/orders of the trial Court as well as the revisional Court, it transpires that in the present case, on the basis of an application submitted by the SHO Sarkanda for physical verification of seized Ganja in Crime No. 1403/2023, Section 20(B) of the NDPS Act registered at Police
6 Station – Sarkanda, Bilaspur, learned JMFC, District – Bilaspur, has given certificate of Section 52A (3) of the NDPS Act by certifying the panchnama and photographs and according to Sub- section 4 of Section 52A of the NDPS Act, and the list of photographs and samples of narcotic drugs, psychotropic substances or transports certified by the JMFC, should be considered as prima facie evidence in relation to such crime by the learned trial Court, no good ground has been raised by the counsel for the petitioner in the present case calling upon this Court for any interference in the present petition. 10. Accordingly, the instant petition under Section 528 of BNSS is devoid of merits, liable to be and is hereby dismissed. 11. A copy of this order be sent to the concerned trial Court for necessary compliance and follow up action, if any.
