Neutral Citation No. - 2025:AHC:81837 Court No. - 80 Case :- APPLICATION U/S 529 BNSS No. - 1247 of 2025 Applicant :- Pranesh Kumar Tripathi Opposite Party :- State of U.P. Counsel for Applicant :- Dinesh Kumar Gupta Counsel for Opposite Party :- G.A. Hon'ble Nalin Kumar Srivastava,J.
1. This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Criminal Case No.64 of 2024 arising out of case crime no.753 of 2022 under Section 392 IPC, P.S. Dhoomanganj, District Prayagraj, pending in the Court of Addl. Chief Judicial Magistrate, Court No.16, Prayagraj, expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It has been submitted by the learned counsel for the applicant that the applicant before this Court is the informant in this case. Charge-sheet in this case was submitted by the I.O. against the sole accused Vikas Verma and so far as the other accused is concerned, investigation in relation to him is still pending. The accused Vikas Verma has appeared before the court and charges against him were framed and the matter is pending for evidence but no evidence has been adduced so far. 4. Since evidence has to be started with the evidence of the informant himself as P.W.1 but surprisingly he is not appearing before the trial court and rather he knocked the door of this Court. It was not required at all. 5. The informant is directed to appear before the trial court through prosecution for the recording of his testimony within one month from today and if the evidence of P.W.1 is recorded before the trial court, it shall make all possible endeavours to dispose of the case under reference as expeditiously as possible without granting any unnecessary adjournments to either of the parties, keeping in view the work load in the said Court, if there is no other legal impediment. 6. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc.
are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 7. With the above observations, the application stands disposed of.
