Learned counsel for the Petitioners would submit that issued to the Petitioners before ordering , no notice was recovery and reducing the basic p^y of the Petitioners, which is the violation of principles of natural justice. Learned counsel would further submit that Deemed University. It is submitted that the degree obtained from Satyabhama Univeristy is recognized under law. 4. Learned Standing Counsel for the University fairly amount was deducted from the salary of the Petitioners without issuing any notice to them. Learned counsel would further submit that the Court appropriate orders. Satyabhama University IS a by the Petitioners conceded that the may pass 5. In the present matter, Respondent-SKIT issued the impugned Proceedings dated 07.12.2018 ordering recovery of amount and to reduce the basic pay of the Petitioners as recommended by District Auditory for the reasons that the Petitioners have not obtained study leave while- pursuing M.Tech., from Satyabhama University, that the degree obtained Satyabhama University is not valid as per the letter issued by JNTUA and that the District Auditor recommended for from recovery since M.Tech., degree is not valid. 6, Admittedly, Respondent-JNTU, Anantapuramu informed vide Letter dated 19.11.2018 that the weekend M.Tech from Satyabhama University i not valid. IS There is no dispute about the fact that the Petitioners herein T \ 5 secured M.Tech., weekend degree from Satyabhama University in the years 2010 and 2011. The appointment orders of the Petitioners would show that, the recommendation of the selection committee, as per the resolution of the general body, they were appointed as Assistant Professors. The Assistant Professors with B.Tech Degree has to obtain M.Tech., / M.E degree in their respective branch from a recognized University within a period of five years from their date of joining, else, they will forfeit their increments and on promotions. In the present case, the Petitioners obtained M.Tech., in their respective branches from Satyabhama University and secured increments from time to Several years thereafter, suddenly the impugned proceedings dated 07.12.2018 were issued by the Correspondent of SKIT directing the Principal of SKIT to take action for recovery of excess amount within two months from the date of the said proceedings. It is also not in dispute that, no prior notice has been issued by giving an opportunity to the Petitioners to give their version much less personal hearing. It is brought to the notice of the Court that, the issue was placed before the Standing Committee for Academic Senate held on 09.10.2019 at JNTU, Ananthapuramu in the presence of Vice Chancellor. The Registrar, JNTUA, addressed a letter to the Registrar of Satyabhama University, which is extracted hereunder; 7. time. 8. ‘Prof. M. Vijaya Kumar M. Tech, Ph. D. Respected Sir, Sub: Sathyabama University, Chennai Recognizing the Part- Time M.Tech. Programs of Sathyabama University, Chennai as equivalent to Regular M.Tech. Programs- Reg. 1. Letter written by the then Registrar, Sathyabama University, Chennai to The Registrar, JNTUA dated 24.09.2019. Ref; 2. Minutes of the Standing Committee for Academic Senate of JNTUA held on 9.10.2019. ★ *** It is to inform you that vide reference (1) cited, you have requested JNTUA to consider the Part-Time M.Tech. Programs offered by Sathyabama University, Chennai as equivalent to the Regular M. Tech. Programs and Sathyabama University is not offering and has not offered earlier any weekend mode M. E/M.Tech. Programs. Your letter along with all the documentary evidences such as approval by AlCTE and UGC Guidelines have been submitted for perusal and approval of the Standing Committee for Academic Senate of JNTUA. The Committee has considered this item and the following resolution M/as made. "JNTUA will consider the M.Tech. Programmes pursued by any faculty of any affiliated College in Part-Time mode from Sathyabama Institute of Science and Technology (Deemed to be University), Chennai as equivalent to M.Tech. (Regular) programmes" Accordingly, the Part-Time. M.Tech Programmes pursued by the following faculty of SKIT, Srikalahasthi are considered as equivalent to M.Tech. (Regular) programmes. 1. Sri A.Lakshmi Narayana, Assistant Professor In CSE 1 Considering the degrees obtained by the Petitioners from Satyabhama University as valid, the Principal of SKIT had issued the office order dated 06.11.2019. Learned Standing Counsel for Respondents placed on record, about the clarification sought from JNTU, Ananthapuramu about the validity of the M.Tech., degree obtained by the Petitioners dated 14.11.2018 and the reply received dated 19.11.2018. However, thereafter, the matter is placed before the Academic Committee and they have taken a decision and thereafter, a letter was addressed by JNTUA to Satyabhama University and obtained positive orders. Then, the Principal of SKIT made office orders receiving the degrees obtained by the Petitioners. It is represented that the College is closed even in the year 2021 and the Petitioners are no more working in the College. Viewed from any angle, the impugned proceedings are not sustainable since, they were issued in violation of Principles of Natural Justice. As this issue is clarified even by the Principal of SKIT considering the degrees of the Petitioners, the issue is resolved. Regarding the representation about the poor condition of the College, they wanted to disengage the teaching and non teaching staff to reduce the financial burden, is concerned, that is not the subject matter in the present petition. It is represented that SKIT College is not functioning since 2021. Such being the case, considering the case of the Petitioners for promotion to the post of Assistant Professor with Senior Scale, 9. t 10. does not arise. 8 11. In the result, the Writ Petition No.46979 of 2018 i aside the impugned proceedings in Rc.No.SKIT amount/2018, dated 07.12.2018. However liberty to take appropriate steps, if law. There shall be no order as to costs. Writ Petition No.22525 of 2011 is disposed of. There shall be - IS disposed of setting - Recovery of excess Respondent No.2- College is at so advised, by following due process Lf no order as to costs.
