ORAL ORDER This petition is preferred by accused No.2 to enlarge him on bail in Crime No.223/2025 of Kumaraswamy Layout Police Station, Bengaluru City, registered for the offence punishable under Section 115(2), 140(2) and 3(5) of BNS, 2023.
2. In the complaint lodged by one Rajesh A., it is alleged that on 18.07.2025 at about 7.15 p.m., after completion of his work, while he was proceeding to his house, he saw four persons abducting two boys aged 20- 22 years, near Indusind Bank, Dayananda Sagara College Road. When he questioned them, they told him that the said boys are selling ganja. The said accused forcibly took both the boys in a car bearing Registration No.KA-19-M-

3. Learned High Court Government Pleader contended that petitioner is one of the accused who abducted the victim. He followed the car in an autorickshaw and the entire incident took place at his instance. He contended that the investigation is in progress and if the petitioner is enlarged on bail, he may tamper with the evidence and flee from justice.
4. It is the case of prosecution that the accused have abducted the two persons in a car bearing Registration No.KA-19-M-5824 and then demanded Rs.2,00,000/- for their release. Statement of the victim has been recorded. It is alleged that the petitioner is also one of the accused who committed the offence along with accused No.1 and he was following the car in an autorickshaw.
5. It is alleged that the accused have totally received Rs.2,00,000/- from the victims and shared the said amount among themselves. Petitioner is said to have

received a sum of Rs.20,000/-. After his arrest, Rs.7,500/- has been recovered from him.

Learned counsel has submitted that the petitioner himself has appeared before the Police on
22.07.2025. A cash of Rs.7,500/-, a mobile phone and an autorickshaw bearing registration No.KA-01-AR-2445 are recovered from him. According to prosecution, the petitioner has followed a car in which the victims were abducted, in an autorickshaw. The allegations that he too is involved in commission of offence is a matter which has to be established in due course. Petitioner has been arrested and interrogated. He is not required for further interrogation. Hence, relief sought by him can be granted by imposing conditions. Accordingly, the following:
ORDER i. Petition is allowed. ii. Petitioner/accused No.2 in Crime No.223/2025 of Kumaraswamy Layout Station, Bengaluru City, shall be enlarged on bail, subject to following conditions:

1. He shall execute a personal bond in a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address.
3. He shall not directly or indirectly tamper with the prosecution witnesses.
4. He shall not indulge himself in committing any offence.
5. He shall appear before the trial Court on every date of hearing without fail. Violation of any of the above condition shall result in cancellation of bail.
