This writ petition has been filed by the petitioner seeking the following reliefs:- “(i) To issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 and 3 to submit progress report of investigation in respect of FIR No.0029/2023 under Section 420, 467, 468, 471, 120-B and 409 of IPC, Police Station Baijnath, District Bageshwar. (ii) To issue a writ, order or direction in the nature of mandamus commanding the respondent no.1, 2 & 3 to ensure fair and impartial investigation and arrest the accused person in FIR No.0029/2023 under Section 420, 467, 468, 471, 120-B, & 409 of IPC, Police Station Baijnath, District Bageshwar by detaining the accused in jail till the pendency of the investigation. 5. This Court while entertaining the writ petition has called the Investigating Officer to find out as what has happened to the investigation pursuant to FIR according to the relief clause. 6. The Investigating Officer was present before this Court on 08.05.2025, on which date being dissatisfied with the progress of the investigation the Investigating Officer was granted four weeks’ time to submit the progress report of the investigation and the case was fixed for today i.e., 12.06.2025 and the Investigating Officer – Mr. Pratap Singh Nagarkoti was directed to remain present before this Court. 7. In sequel to order dated 08.05.2025 the Investigating 2 Officer – Mr. Pratap Singh Nagarkoti is present before this Court, who submitted the progress report through State counsel to this Court and apprised that after investigation final report has been submitted in favour of respondent nos.4 and 5. 8. Since the final report has been submitted after investigation, nothing remains to be decided in the present writ petition. 9. Accordingly writ petition is dismissed as infructuous; however the petitioner is free to avail the legal remedy available to him, in accordance with law. (Pankaj Purohit, J.) 12.06.2025 SK
