1. The petitioner is aggrieved by the impugned proceedings dated 26.06.2023, whereby the petitioner was directed to remove the cattle shed and to stop further activity in the premises bearing No. 61-10/1- 8 of Ramalingeswara Nagar, Vijayawada. 2. The learned counsel for the petitioner submits that the 2nd respondent could not have passed the impugned proceedings without granting adequate and fair opportunity to the petitioner. 3. This Court, vide order dated 13.08.2025, suspended the operation of the impugned proceedings. 4. The learned Senior Counsel appearing for the 7th respondent submits that the respondent authorities had provided ample opportunity to the petitioner to submit an explanation, but the petitioner chose to file an evasive reply with the intention of seeking further time. On account of such evasive methods adopted by the petitioner, the respondent authorities have rightly passed the impugned proceedings. 5. Considering the submissions advanced by the learned counsel for the petitioner, the learned Senior Counsel appearing for the 7th respondent and the learned Standing Counsel for respondents 2 to 6, this Court directs respondents 2 to 6 to fix a fresh date of hearing,

duly informing the petitioner about the date and place of such hearing, and thereafter pass appropriate orders in accordance with law after affording the petitioner an opportunity of being heard. The entire exercise shall be completed within a period of four weeks from the date of receipt of this order. 6. It is further apprehended by the learned Senior Counsel for the 7th respondent that the petitioner may raise queries unconnected to the issue which has to be considered by the 2nd respondent. 7.
Considering the said submission, respondents 2 to 6 are directed to furnish only such information as may be relevant and necessary, if any sought by the petitioner. 8. It is also made clear that the petitioner shall not be at liberty to seek information unconnected with his business or activities relating to the said premises. 9. Accordingly, the writ petition is disposed of. No costs. 10. Pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N BV
