ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ^ seeking to enlarge the Petitioner/Accused'No.1 on bail in Crime No.22 of 2025 of Kunavaram Police Station, Alluri Sitharama Raju District, was registered against the Petitioner/Accused No.1 herein for the offences punishable under Section 8(c) read with Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic The BNSS

2. As seen from the record, this Court, in Crl.P.No.9299 of 2025 dated 25.09.2025, enlarged Accused No.2 on bail. The Petitioner/Accuse d No.1 is alleged to have dealt with 21 Kgs of ganja with the assistance of Accused Nos.2 and
3. No doubt, the contraband involved is of commercial quantity. The alleged role of the Petitioner has come to light solely based on the confessional statements of Accused Nos.2 and
3. The inventory has been completed. Except for the confessions of Accused Nos.2 ahd 3 implicating the Petitioner, no other material has been collected by the investigating officer. 3. The Petitioner was arrested on 09.07.2025 and has been in judicial custody for the past 98 days. He is a permanent resident of G. Neredupalli Village, G.K. Veedhi Mandal, ASR District, and has a fixed place of residence. So far, five witnesses have been examined. Hence, the possibility of the Petitioner evading the process of law appears to be minimal. 4. Considering the facts and circumstances of the case, the nature and gravity of the allegations leveled against the Petitioner/Accused No.1, this Court is inclined to enlarge the Petitioner/Accused No.1 on bail. 5. ^ The NDPS Act
3 In the result, the Criminal Petition is allowed with the following stringent conditions; i. The .Petitioner/Accused No.1 shall be enlarged on bail subject to them executing a personal bond for a sum of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties for the like sum each to the satisfaction of the learned Judicial I Class Magistrate, Ramapachodavaram. ii. The Petitioner/Accusid No.1 shall appear before the Station House Officer conterned, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court. iii.
Tine Petitioner/Accused No.1 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioner/Accused No.1 shall not commit or indulge in commission of any offence in future. V. The Petitioner/Accused No.1 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer, vi. The Petitioner/Accused No.1 shall surrender his passport, if any, to the investigating officer. If he claims that he does not have a passport, he shall submit an affidavits to that effect to the Investigating Officer.
