IN THE PUNJAB AND HARYANA HIGH COURT AT CHANDIGARH 117 CWP-12871-2025 Date of Decision: 07.05.2025 GAUTAM AND OTHERS ... Petitioners VERSUS STATE OF HARYANA AND OTHERS ... Respondents CORAM: HON'BLE MR. JUSTICE VINOD S. BHARDWAJ. **** Present: Mr. Ravinder Singh Dhull, Advocate for the petitioner. **** VINOD S. BHARDWAJ, J. (ORAL) Prayer made in the present petition is for directing respondent No.1 to release the salary of the petitioners from the date of their joining till a final decision is taken w.r.t. their employment. Learned counsel for the petitioners contends that the petitioners were selected on the Group-D posts as per the roll numbers and thereafter they joined in the month of March 2024 with respondents No.4 to 6. He contends that petitioners No.1 and 2 had been issued Sports Gradation Certificate under the 1993 Policy while petitioners No.3 and 4 had not been issued any Certificate and they only have a sports participation achievement. He contends that the petitioners have been informed that respondent No.2-Commission committed an error in recommending the candidature of the petitioners and hence, a final decision w.r.t. to their recommendations by respondent No.2- Commission is yet to be taken. He thus confines his prayer that the respondents be directed to pay the salary to the petitioners for the period for which they have worked pursuant to the recommendations of respondent No.2-Commission. Ms. Tanisha Peshawaria, DAG, Haryana accepts notice on behalf of the respondents and contends that the salaries of the petitioners for the period for which they have worked and discharged their duties would be released within a period of six weeks from today. Faced with the above, learned counsel for the petitioner does not press the instant petition at this stage. Disposed of as not pressed at this stage. The State shall, however, remain bound by the undertaking given today in Court by the learned State Counsel to release the salaries of the petitioners for the period for which they have actually worked and till such time that the respondents take an actual decision w.r.t. the status of employment of the petitioners. It is made clear that in the event, the salaries are not released within the period as undertaken today, the petitioners shall be entitled to interest @ 6% per annum. The respondents-Authorities would be at liberty to recover the additional interest liability from the erring official(s). (VINOD S. BHARDWAJ) MAY 07, 2025.
