GP FOR REVENUE (AP) 3 HBKM,J W.P.No.4730 of 2020 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondent No.4 thereby directing the petitioners herein to evict from their Agriculture land admeasuring an extent of Ac.1-10 Cents in Survey No.13 situated at Billawaka Village, H/o. S.Agraharam, Rowthulapudi Mandal, East Godavari District and the Agriculture land admeasuring an extent of Ac.0-77 Cents in Survey No.13 situated at Billawaka Village, H/o. S.Agraharam, Rowthulapudi Mandal, East Godavari District. 3. Inspite of giving number of adjournments, i.e., on 17.04.2025, 01.05.2025, 31.07.2025, 21.08.2025, 01.09.2025 and 16.09.2025, the learned Government Pleader for Revenue could not file counter affidavit for the respondents. Inspite of specific order of this Court dated 21.08.2025, to get instructions with respect to the issuance of the proceedings of the Mandal Revenue Officer, dated 07.01.1987, with respect to the subject land, if any, the same is not furnished by the learned Government Pleader through the learned Assistant Government Pleader. However, the learned Assistant Government Pleader appearing for the respondents submits that the respondent authorities concerned will follow the due procedure with respect to the subject land. 4 HBKM,J W.P.No.4730 of 2020 4. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject land in an extent of Ac.1-10 Cents in Survey No.13 and an extent of Ac.0-77 Cents in Survey No.13 situated in Billawaka Village, H/o. S.Agraharam, Rowthulapudi Mandal, East Godavari District, strictly in accordance with law, if so warranted for any public purpose and if the petitioners are otherwise found to be in possession of the same, they shall be dealt with strictly in accordance with law, by hearing all the parties concerned, including the petitioners, giving due opportunity, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits. Any dispossession from the subject land shall not be made except by following the due process of law. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
