Neutral Citation No. - 2025:AHC:84802-DB Court No. - 29 Case :- WRIT - C No. - 14372 of 2025 Petitioner :- Ms. Manishri Pal Respondent :- Union Of India And Another Counsel for Petitioner :- Vinod Mishra Counsel for Respondent :- A.S.G.I.,Anand Tiwari,Manoj Kumar Singh Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J. Petitioner applied as a partnership firm for allotment of a retail outlet alongwith another partner, who has subsequently withdrawn from the partnership firm. It is for this reason that the application of the petitioner has not been treated as an application filed on behalf of the partnership firm and appropriate communication in that regard has been made. Aggrieved by such action the petitioner is before this Court.
Learned counsel for the petitioner submits that the partner could withdraw from the partnership firm only after seeking permission from the oil company. Sri Anand Tiwari for the Oil Company and Sri Manoj Kumar Singh for Union of India have opposed the prayer made in the writ petition. From the materials placed on record, it appears that there is a dispute between the partners and in case one of the partners withdrawn from the partnership firm and the application of the petitioner as a firm is not being entertained no exception can be taken to it. So far as the dispute between the petitioner and his partner is concerned, the remedy would lie elsewhere. The writ petition, accordingly, is dismissed.
