1. This is second bail application filed by the applicant under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of bail as she has been arrested on 16.05.2023 in connection with Crime No. 136/2023, registered at Police Station Lailunga, District Raigarh (C.G.) for commission of offence punishable under Sections 302, 201 and 34 of the Indian Penal Code, 1860. Her first bail application was dismissed on merits by this Court vide order dated 12.10.2023 passed in M.Cr.C. No. 5401 of 2023.
2. Case of the prosecution, in brief, is that the deceased, who happens to be the son of the applicant, had gone to pursue his study at High School,
2 Jashpur and was residing at Hostel. When he came back to his home, a quarrel took place between him and his parents on a trivial issues, upon which the father of the deceased, who is also the main accused in the crime in question, assaulted the deceased by bamboo stick over his head, as a result thereof, son of the applicant (deceased) sustained multiple injuries and succumbed to those injuries on the spot itself. Thereafter, the body of the deceased was taken to Tongry Forest and was thrown away there. Upon an information received from informant, a case was registered and after usual investigation, the present applicant and the co-accused were arrested for the aforesaid offences.

Learned counsel appearing for the applicant / accused submits that the applicant is innocent and has been falsely implicated in the crime in question. He further submits that applicant’s first bail application bearing M.Cr.C.No. 5401 of 2023 was rejected on merits by this Court vide order dated 12.10.2023, thereafter, till date only five prosecution witnesses have been examined, out of total 13 prosecution witnesses. He submits that the present applicant is mother of the deceased, but she has not assaulted the deceased, rather main accused namely, Kuhuru Singar, who is father of deceased, has assaulted the deceased by bamboo stick on his head, due to which, he sustained severe injuries and died in the spot itself. It is submitted that as per the case of the prosecution itself, only allegation against the present applicant is of concealing the dead body after committing the murder of the deceased. He submits that the applicant, who is lady, is languishing in jail since 16.05.2023, charge-sheet has already been filed and conclusion of the trial is likely to take long time, hence, the applicant may be released on bail.
4. Per contra, learned counsel for the State while opposing the submission made by counsel for the applicant submits that looking to the seriousness of the crime, the applicant is not entitled to be released on bail.

5. I have heard learned counsel for the parties and perused the material available on record.
6. Having heard learned counsel for the parties, having regard to the
facts & circumstances of the case, particularly, considering the fact that applicant, who is lady, is in custody since long i.e. from 16.05.2023 and the fact the she is not the main assailant and conclusion of the trial is likely to taken long time, I feel inclined to release the applicant on bail.
7. Accordingly, the second bail application is allowed. It is directed that applicant shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- with one solvent surety for the like amount to the satisfaction of the concerned trial Court. She shall be released on bail on the following conditions. (i) She shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court, (ii) She shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) She shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (iv) She shall not involve herself in any offence of similar nature in future.
