GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 12511/2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondent Nos. 3 and 4 in calling the petitioners to Police Station frequently without there being any crime registered against them and in interfering with the civil liberties of petitioners and to settle disputes interse the petitioners and the 5th Respondent with the Village Elders, as illegal, arbitrary, without jurisdiction and violative of Art. 14 of Constitution of India and to consequently direct the Respondent Nos. 3 and 4 not to interfere with the civil liberties of petitioner and not to interfere with the civil disputes between the petitioners and the 5th Respondent and also not to call the petitioners to Police Station without there being any crime registered against them.…” 2. None represented for the petitioners. 3. When the matter is taken up for hearing, Sri P.Ajay Babu, learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the representation made by the unofficial respondent, the petitioners were called to the police station for preliminary enquiry. He would further submit that the petitioners along with elders came to the police station and after due counseling, the petitioner No.1 gave an undertaking in the presence of elders to marry the unofficial respondent and the unofficial respondent No.5 have stated no further action is required. Recording the same, the respondent-police have closed the petition. Learned Assistant Government Pleader for Home, would further submit that the police are not 4 interfering in the matrimonial disputes between the petitioner No.1 and the unofficial respondent and no crime has been registered against the petitioners. 4. Recording the above submissions, this Writ Petition is disposed of. However, the police are directed not to call the petitioners to the police station without there being any crime registered against them, except under due process of law. No order as to costs.
