Neutral Citation No. - 2025:AHC:84857-DB Court No. - 29 Case :- WRIT - C No. - 14320 of 2025 Petitioner :- Lalit Kumar Jaiswal Respondent :- Chief Branch Manager, Bank Of Maharashtra And Anoter Counsel for Petitioner :- Awadhesh Kumar Malviya Counsel for Respondent :- Shruti Malviya Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J. Petitioner before this Court is the auction purchaser. He is claiming interest on the amount deposited by him pursuant to auction in respect of which sale certificate was also issued. The auction proceedings were under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. It transpires that the defaulter approached the Debt Recovery Tribunal wherein the petitioner was also a party. The DRT has passed an order permitting the Bank to withdraw the recovery proceedings and to proceed afresh, in accordance with law. The amount deposited by the petitioner has been refunded pursuant to the orders of the DRT. The order of DRT is not under challenge before us. In such circumstances, the writ petition would not be entertained merely for payment of interest to the petitioner. In the event petitioner was so aggrieved, he could have pursued the remedy before the DRT where he was already represented. No relief can be granted in the writ petition, which accordingly, is consigned to records.
