Neutral Citation No. - 2025:AHC:73287-DB Chief Justice's Court Case :- WRIT TAX No. - 2074 of 2025 Petitioner :- Smt. Neelam Singh Respondent :- The State of U.P. and 3 others Counsel for Petitioner :- Utkarsh Prasad Counsel for Respondent :- Nimai Dass (A.C.S.C.) Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J.
1. Heard learned counsel appearing on behalf of the parties.
2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the order dated March 29, 2025 passed by the District Magistrate, Shahjahanpur, being the respondent No.3 herein, cancelling the licence of the petitioner and forfeiting the basic licence fee and security amount.
3. Upon considering the submissions of learned counsel appearing on behalf of the parties and perusing the impugned order, it is crystal clear that the authorities have simply cut paste the show cause notice, and thereafter, held the petitioner guilty without assigning any specific reason for the same. The only reason given is that the reply filed by the petitioner is not satisfactory. While brevity may be a virtue, however, reasons are the soul of an order and if an order is bereft of reasons, the same cannot be allowed to stand.
4. In light of the above observations, the writ petition is allowed. The impugned order dated March 29, 2025 is quashed and set- aside with a direction upon the authority concerned to grant an opportunity of hearing to the petitioner, and thereafter, pass a fresh reasoned order in accordance with law within a period of twelve weeks from date.
