JUSTICE NEENA BANSAL KRISHNA O R D E R % 13.10.2025 1. Writ Petition under Article 226 of Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of FIR No. 0167/2025 registered under Sections 420/406/34 IPC at P.S. GTB Enclave, Delhi on the basis of Settlement Agreement dated 15.08.2025. 2. The Complainant is present in person, who endorses that he has settled the matter with the Petitioner. 3. Learned Standing Counsel on behalf of the State, however, has taken an objection on the quashing on the ground that there are two other Accused persons and there is a complicity between the Petitioner and the other co- accused and the FIR has been registered by invoking Section 34 IPC. The Anticipatory Bail Application in which the Petitioner was granted Interim Protection, already stands dismissed. It is, therefore, submitted that since the investigations are still ongoing to investigate the role of the Petitioner as well as the other co- accused persons, the matter cannot be quashed. Submissions heard and record perused. 5. The investigation is still at initial stage whereby the role not only of the Petitioner but also of other two co-accused, are under investigations. In these circumstances, such partial quashing of the FIR would have an impact on the investigations, which are underway vis-à-vis the other two Accused. 6. In the circumstances of the present case, quashing with one Accused is not merited. Accordingly, the present Petition alongwith pending Applications, is hereby dismissed.
