I.A.No.1/2025 for dispensation is allowed. 3. Petitioner is before this Court seeking for the following relief: "Issue a writ of Certiorari, quashing the impugned Endorsement Letter dated 07.07.2025 issued by the District Police Office, Chitradurga, recommending denial of No Objection Certificate (NOC) for the establishment of a Petrol and Diesel retail outlet by the petitioner in survey Nos.90/3 and 90/5 of Arehalli Village, Holalkere Taluk, Chitradurga District, which is produced as Annexure-G". 4. What is challenged is the communication of the District Police Office, Chitradurga to the Deputy Commissioner as regard the enquiry made if there is any criminal proceedings which are pending - 3 - HC-KAR NC: 2025:KHC:44322 WP No. 24314 of 2025 against the petitioner. In the report which has been submitted reference has been made to a criminal proceeding in Crime No.149/2020 which is now pending in C.C.No.1920/2021. 5. On enquiry with the learned counsel for the petitioner as to whether any such proceeding is pending, he fairly submits that said proceeding is pending. 6. In that view of the matter, the report which has been submitted by the District Police Office is based on facts and the communication which has been sent to the Deputy Commissioner would be considered by the Deputy Commissioner in terms of the applicable law. Such a communication which is based on facts cannot be questioned or sought to be quashed in the manner as done. 7.
