20.01.2025 Ct. No.1 IN THE HIGH COURT AT CALCUTTA Sl. No.37 Circuit Bench at Jalpaiguri akd [Rejected] C. R. M. (A) 848 of 2024 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed on 05.11.2024 in connection with Cyber Crime Police Station Case No.102 of 2024 dated 14.09.2024 under Sections 419/420/384/120B of the Indian Penal Code. (G.R. Case No.3222 of 2024) And In Re: Abinash Jaiswal … … Petitioner Mr. Aniruddha Biswas Mr. Arijit Ghosh Ms. Sudipa Ghosh Mr. Manoj Saha … … for the petitioner Mr. Nilay Chakraborty .. ld. Addl. Public Prosecutor Dr. Arjun Chowdhury … … for the State 1. It is submitted on behalf of the petitioner that he is in no way connected with the alleged cyber extortion. It is further submitted petitioner has not been named in the FIR. He has cooperated with investigation. Accordingly, he prays for anticipatory bail. 2. Learned Advocate for the State opposes the prayer for anticipatory bail. 3. We have considered the materials on record. Allegations in the FIR depict a case of cyber extortion. De-facto complainant is a government employee. He received a number of phone calls alleging his objectionable videos will be circulated if he did not make payment. As a result he was extorted to pay money. Investigation reveals the extorted money was routed through the petitioner’s account. Custodial 2 interrogation to unravel the ramifications of crime is necessary. Hence, we are not inclined to grant anticipatory bail to the petitioner. 4. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
