This Writ Petition is filed under Article 226 of the Constitution of India seeking the following prayer;
“….pleased to issue order or direction more particularly one in the nature of Writ of MANDAMUS declaring the action of the 2nd and 3rd respondents and their subordinate staff seeking to disposes the petitioner from her land to an extent of Ac.3.89 cents situated in Sy.No.48/1 of Vaidapudi Village, Maredumilli Mandal, East Godavari District, presently Alluri Sitha Rama Raju District as illegal, arbitrary, unjust and consequently, direct the respondents not to interfere and dispossess the petitioner from her land without following the due process of law”. 2.
2. Grievance of the petitioner is that he belongs to Scheduled Tribe, Konda Reddy Community. An extent of Ac.3.89 cents situated in Sy.No.48/1 of Vaidapudi Village, Maredumilli Mandal, East Godavari District, presently Alluri Sitha Rama Raju District, was assigned to him in the year 2013 and the said land was situated in schedule area. The petitioner has been in physical possession and cultivating the land with cashew nut plantation. Revenue records also disclose that the petitioner was owner and possessor of the aforesaid land. While the matter stood thus, respondent Nos.2 and 3 are interfering with the peaceful possession and enjoyment of the petitioner over the subject land at the instance of respondent Nos.4 and 5 who are no way concerned with it. Learned Assistant Government Pleader appearing on behalf of the respondents, on written instructions, submits that possession of the petitioner has not been disturbed by the respondent Nos.2 and 3 and their subordinate staff. It is further stated that in the event of any action becomes necessary or if any petition is filed, they will follow the due process of law. 4. Placing the said written instructions on record, the respondents are directed to follow the due process of law in the event of any petition filed or action necessary in respect of the subject land. 5. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
