Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for following relief: "I. Issue an order or direction under the supervisory jurisdiction of Hon,ble High court pleased to direct the learned court i.e. Sub Divisional officer Deoria to conclude and dispose off the Restoration application no. T202305200107703 (Nar Singh & others Vs. ram Chhabila & others) under Order 9 Rule 4 of C.P.C. for restoration of the Original Suit No. 398 of 1987 (Khusihal Vs. Bharat & & others) under section 229 B U.P.Z.A & LR.ACT as well as original also, within some stipulated period of time which is fixed by this Hon,ble court may deem fit and proper." 3. Contention of the learned counsel for the petitioners is that the aforementioned restoration application is pending before the Sub Divisional officer, Deoria for adjudication. He prayed that the same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. The present petition stands disposed of finally with a direction to the Sub Divisional officer, Deoria to consider and decide the aforementioned restoration application, in accordance with law, expeditiously, preferably within a period of twelve weeks from the date of production of a certified copy of this order after ensuring service upon all the respondents and after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
