It remains undisputed that till date, no decision has been taken. 2. In any case, if the decision is taken by the concerned authority, the same must be in accordance with law. The petitioner, thereafter, shall have all rights and liberties to take appropriate remedy. It, however, at this stage, is not necessary to undertake a pre-emptive exercise. The same shall depend upon an action, if at all required to be taken by the Excise Department. 3. Petition stands disposed of. 4. All rights and contentions are left open.
