GP FOR REVENUE (AP) SRK, J W.P.No.22694 of 2015 3 The Court made the following ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent Nos.2 and 3 in seeking to evict the petitioners from their lands to an extent of Ac.2.00 cents in Sy.No.19/1 and Ac.3.00 cents in Sy. No.22/1 respectively situated at 59 Kothurupadu village, Addateegala Mandal, East Godavari District as illegal and arbitrary” 2. Case of petitioners is that they are the absolute owners and possessors of lands to an extent of Ac.2.00 cents in Sy.No.19/1 and Ac.3.00 cents in Sy. No.22/1 respectively situated at 59- Kothurupadu village, Addateegala Mandal, East Godavari District, but the respondent Nos.2 and 3 are trying to dispossess the petitioners from the lawful possession of the property without issuing any notice. 3. The learned Assistant Government Pleader, on written instructions submitted by 2nd respondent-Tahsildar, Addateegala, submits that the subject lands i.e., Ac.2.00 cents in Sy.No.19/1 and Ac.3.00 cents in Sy. No.22/1 respectively are in possession SRK, J W.P.No.22694 of 2015 4 and enjoyment of petitioner Nos.1 and 2, without any lawful title and the revenue authorities are not trying to evict them over the said lands. The written instructions submitted by 2nd respondent- Tahsildar, Addateegala are placed on record. 4. Recording the said submission of the learned Assistant Government Pleader, the Writ Petition is disposed of. The respondents are directed not to interfere with the petitioners’ peaceful possession and enjoyment of the subject properties, except by due process of law. There shall be no order as to costs. 5.
