(ORAL) 1. In the light of the prevailing sensitive situation, the Lawyers are abstaining from work today i.e. 09.05.2025. 2. In the present writ petition, the grievance being raised by the petitioners is that they are entitled for the higher pension keeping in view the judgment of the Hon’ble Supreme Court of India in SLP (Civil) No.8658-8659 of 2019 titled as The Employees Provident Fund Organizations and another vs. Sunil Kumar B and others, decided on 04.11.2022 but the said benefit is not being extended to the petitioners without any valid justification. 3. From the pleadings, it transpires that the grievance being raised in the present writ petition has already been raised by the petitioners in the Kanchan 2025.05.12 12:38 I attest to the accuracy and integrity of this order/judgment CWP-13261-2025 2 legal notice dated 07.01.2025 (Annexure P-3), which is still pending consideration with the respondents and the interest of justice, will be served in case a time bound direction is issued to the respondent No.3 to decide the said legal notice by passing an appropriate speaking order. 4. Keeping in view the prayer of the petitioners, the present writ petition is disposed of with a direction to respondent No.3 to decide the legal notice of the petitioners dated 07.01.2025 (Annexure P-3) by passing an appropriate speaking order within a period of eight weeks from the date of receipt of copy of this order and in case, after the decision any relief is to be extended to the petitioners, the same will be extended, otherwise due reasons will be mentioned in the speaking order to be passed for not accepting the claim of the petitioners for their information and necessary action.
