The present writ petition has been filed seeking directions to the respondent no.1/MCD, to take action against the illegal and unauthorized construction raised by the respondent no.2, on the ground floor of the property bearing No. 19B, Lajpat Nagar-II, New Delhi, including, the portions of the property in question constructed in deviation of the sanctioned plan, encroaching upon the common passage and obstructing access to the upper floors. 2. Status report has been filed on behalf of the respondent/MCD wherein it is stated that the subject property was inspected and at the time of inspection neither any construction activity nor any building material was found at the site.
