P NAGENDRA REDDY The Court made the following: COMMON ORDER: The instant petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioners/Accused Nos.1 and 2, seeking to quash the proceeding in SC/ST S.C.No.23 of 2020 on the file of the learned Special Judge for Trial of cases under SCs and the STs (PoA) Act-cum-VI Additional Sessions 2 Judge, Kurnool, for the offences under Sections 323 and 506 read with 34 IPC and Sections 3(1)(r)(s) of the SCs and the STs (PoA) Amendment Act, 2015. 2. I.A.Nos.2 and 3 of 2025 are filed by Respondent No.2/Complainant seeking permission to compound the offences alleged against the petitioners, and to record the compromise in the present case. 3. Petitioners/Accused Nos.1 and 2 and Respondent No.2 appeared before this Court and were identified by their respective learned counsel. Copies of their Aadhar cards attested by their respective counsel are filed for proper identification. 4. Learned counsel prays to allow the petition by exercising the inherent jurisdiction under Section 528 of BNSS. 5. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 6. Respondent No.2 submits that he has not received any compensation in this case. Hence, the case may be closed. 7. Considering the submissions and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1, since there is an amicable settlement between the parties, I.A.Nos.2 and 3 of 2025 are allowed. Consequently, the Criminal Petition is allowed and the SC/ST S.C.No.23 of 2020 on the file of the learned Special Judge for Trial of cases under SCs and the STs (PoA) Act-cum-VI Additional 1 2012(10)SCC 303 3 Sessions Judge, Kurnool, for the offences under Sections 323 and 506 read with 34 IPC and Sections 3(1)(r)(s) of the SCs and the STs (PoA) Amendment Act, 2015, is hereby quashed.
