1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 427/2025 registered at Police Station – Civil Line, District – Raipur (C.G.) for the offences punishable under Sections 420, 120-B & 34 of the IPC.
2. The prosecution story in brief is that that the complainant Shashikant Tiwari filed written complaint before the police station Civil Line Raipur stating that on 05.06.2024 he and his partner Sudheer Maggu VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.10.17 11:33:43 +0530
2 executed a agreements for purchasing the agricultural lands admeasuring area 70 acres for rate of Rs. 08,51,786/- per acre, from bail reje (wrongly mentioned in various former at village Barbhatha, P.S. Patewa, District Mahasamund through the broker Tajdar Khan and from the aforesaid agreement they have paid total of Rs. 01,00,05,000/- from various dates including the amount of brokerage. That thereafter on 21.03.2025 the another agreement was executed between complainant and Tajdar Khan for returned the aforesaid amount in part and given 3 cheques in which one cheques of Rs, 10 Lacs had been dishonored on 05.05.2025 for insufficient funds,
3. The applicant is innocent and has been falsely implicated in the instant case. The complainant had earlier filed a written complaint before the Superintendent of Police, Mahasamund, on the same set of
facts, which was not considered, and thereafter submitted another complaint before the SHO, Civil Line, Raipur. The present applicant, through his advocate, also moved an application under the RTI Act before the SP, Mahasamund, seeking information regarding the said complaint, but no reply has been received to date. The agreement in question was executed between the complainant and the concerned farmers, and the payment was duly made to the farmers’ accounts. Although the applicant had issued a cheque, the complainant never presented it to the bank and instead lodged a false criminal complaint. The entire dispute is purely civil in nature, but the complainant has deliberately given it a criminal colour and filed the complaint at a place that has no jurisdiction, therefore, he prays for grant of anticipatory bail to the applicant. 3
4. On the other hand, learned State Counsel as well as learned counsel for the objector opposed the anticipatory bail application of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the material available in the case diary, it is noted that the main accused in this case is already in jail, without expressing any opinion on the merits of the case or the allegations, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Sanjeet Jangde, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
4 (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
