The Court made the following ORDER: This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:
“…..to issue an order or direction or writ, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2,3 interfering with the private land of the petitioners situated at Duvvada Village, Gajuwaka Mandalam, Visakhapatnam District in Sy.no.88/18, plot nos.
4,5,7 of an extents of 300 Sqyds, 332.5 sq.yds, and 166.66 sqyds respectively without considering the representation dated 3.10.2025, as highly arbitrary, illegal, null and void and against the principles of natural justice and violation of Articles 21 and 300-A of the Constitution of India and consequently to direct the respondents 2,3, not to interfere with the private lands of the petitioners situated at Duvvada Village, Gajuwaka Mandalam, Visakhapatnam District in Sy.no.88/18, plot nos. 4,5,7 of an extents of 300 Sqyds, 332.5 sq.yds, and 166.66 sq.yds respectively ….”
2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for the respondents. 3. Learned Assistant Government Pleader submits that he has received instructions dated 31.10.2025 from the Tahsildar/ 2nd respondent stating that based on the field verification, it came to the knowledge of the authorities that the petitioners herein have encroached the Government land. 4. Considering the said submissions, this Court is not inclined to go into the merits of the case and the respondents are at liberty to take appropriate

action as per the provisions of the AP Land Encroachment Act, if there are any encroachments. Till such time, respondents are directed not to dispossess the petitioners from the subject property. 5.
