Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed for following reliefs:- "A. Issue a writ order or direction in the nature of mandamus directing the the respondent no.2 to decide the Restoration Application along with section 5 and stay application dated 15.2.2025 in Computerized Case No. T202415060204533 (Amir Mumtaj and others Vs. Gaon Sabha and others) under section 24 U.P. Revenue Code 2006 pending before him finally a suitable period of time as well as restrain to private respondent no. 4 to 7 to not a demolish the boundary (Merh) to the petitioner's Bhumidhari land till the disposal of case. B. Issue a writ order or direction in the nature of mandamus directing/restraining to private respondent no. 4 to 7 to not a demolish the boundary (Merh) the petitioner's Bhumidhari land till the disposal of case." 3. Contention of learned counsel for the petitioner is that restoration application of the petitioner is pending since 15.02.2025. He prayed that same may be decided expeditiously. 4. No useful purpose would be served in keeping this petition pending. 5. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to respondent No.2 - Sub- Divisional Magistrate, (Up-Ziladhikari) Nizamabad, District Azamagarh to consider and decide the restoration application, in accordance with law, expeditiously, preferably within a period of twelve weeks from the date of production of a certified copy of this order after ensuring service upon the opposite parties as well as giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided there is no other legal impediment.
