GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 1991 of 2024 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue writ, order or orders specially one in the nature of Writ of Mandamus declaring the of the 3rd and 4th respondents in calling petitioner and instating him to vacate the flat no.302, Mourya garden, Behind AIM school, Totapalem, Vizianagaram and also directing him to withdraw the G.W.O.P No.28 of 2023, on the file of Principal District Court, Vijayanagaram, at the behest of the 5th respondent and also calling petitioner to police station without any crime being registered against him, as illegal, arbitrary, violative of Arts.21 of the Constitution of India and misuse of powers vested with the office of 3rd and 4th respondents and consequently desist the 3rd & 4th respondents from interfering with petitioner’s possession and enjoyment of flat no.302, Mouiya garden, Behind AIM school, Totapalem, Vizianagaram and also in the civi/matrimonial dispute between the petitioner and the 5th respondent pending before the competent civil court.…” 2. Heard Sri T.V.Jaggi Reddy, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home 3. Learned counsel for the petitioner would submit that the police are calling the petitioner to the police station without there being any crime registered against the petitioner. 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that the respondent-police never called the petitioner to the police station and no crime has been registered against him. 4 He would further submit that they are not interfering in the civil disputes between the petitioner and the 5th respondent. 5. Recording the above said submissions, this Writ Petition is disposed of. However, the police are directed not to call the petitioner to the police station without therebeing any crime registered against him. There shall be no order as to costs.
