JUSTICE ALOK JAIN Present: Mr. Anshul Jain, Advocate, for the petitioner. *** SUDHIR SINGH (ORAL) By way of the present writ petition, the petitioner has sought issuance of an appropriate writ in the nature of Mandamus directing the respondents to refund an amount of Rs.20,52,185/- (Rs.19,79,250/- as PLC, Rs.27,500/- as increased area charges and Rs.45,435/- as cancer cess charges) along with interest, which was deposited by the petitioner under protest vide receipt dated 21.08.2023 (Annexure P-4). 2. Learned counsel for the petitioner submits that the petitioner has already served legal notice dated 17.02.2025 (Annexure P-6) upon the competent authority, but no action has been taken thereon till date. Served with the advance copy of the petition, Ms. Arundhati Kulshreshtha, AAG, Punjab, appears on behalf of the respondent-State and Ms. Avin Kaur Sandhu, Advocate, appears on behalf of respondent Nos.2 and 3-GMADA. Learned counsel for respondent Nos.2 and 3 submits that the said legal notice shall be considered and decided by the competent authority, in accordance with law. 4. Without commenting on merits of the case, the present petition is disposed of with a direction to respondent No.3-Estate Officer, GMADA (competent authority), to look into the aforesaid legal notice dated 17.02.2025 (Annexure P-6) of the petitioner and pass an appropriate reasoned order thereon, in accordance with law, preferably within a period of eight weeks from the date of receipt of copy/production of this order. 5. Pending application(s), if any, shall also stand disposed of.
