1. The Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a Writ Order or direction particularly, one in the nature of writ of Mandamus declaring the high-handed action of the 3rd Respondent/Tahsiidar, who has threatened to forcibly dispossess the petitioner from his property admeasuring 120 square feet (15 Ankanalu) of vacant land, including a Cool Drink Shop bearing H.No.2-167, Assessment No.450, situated in Sy.No.1 of Mopuru Village Road Centre, Mopuru Village, Dakkili Mandal, Tirupathi District, without issuing any notice and without following due process of law, which is violative of the principles of natural justice and Article 300-A of the Constitution of India and consequently direct the 3rd respondent not to interfere with the peaceful possession and enjoyment of the petitioner's property admeasuring 120 square feet (15 Ankanalu)of vacant iand,including a Cool Drink Shop bearing H.No.2-167, Assessment No.450, situated in Sy.No.1 of Mopuru Village Road Centre, Mopuru Village, Dakkili Mandal, Tirupathi District, without issuing any notice and without following due process of law….”
2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The writ petition is filed aggrieved by the notice dated 01.12.2025 issued by the 3rd respondent–Tahsildar. On a perusal of the said notice, it is evident that the same was issued on the basis of a complaint made by Smt. Kavidi Pushpavati, W/o. Pichaiyya, Mopuru, and that the dispute pertains purely to a private property. 4.
On further perusal of the impugned notice, this Court is surprised to note that the contents thereof clearly disclose the existence of a private civil
dispute between the parties. The 3rd respondent–Tahsildar, being a revenue authority, ought not to have entertained or intervened in a private property dispute, nor issued a notice restraining interference in such matters, which fall exclusively within the domain of the competent civil court. 5. In view of the above, this Court is of the considered view that the impugned notice dated 01.12.2025 is without jurisdiction and unsustainable in law. Accordingly, the writ petition is allowed and the impugned notice dated 01.12.2025 issued by the 3rd respondent is hereby set aside. No order as to costs.
