The applicant has preferred this first anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 595/2025, registered at Police Station – Civil Line Rampur, District- Korba (C.G.) for alleged commission of offence punishable under Sections 296, 126, 351(2), 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 25 and 27 of the Arms Act. The case of the prosecution, in brief, is that on 28.09.2025 at around 12:45 AM, the complainant, Aayush Agrawal, was returning after dropping his mother at home when the accused, Mitesh Kenwat, along with his associates Santosh Tiwari, Chandrapal (the applicant), and some other individuals, allegedly surrounded the complainant near Bhatiya Store and attempted to assault him with a knife. However, the knife was reportedly snatched away by Vaibhav Sharma. It is further alleged that some members of the Garba Committee arrived at the scene to rescue the complainant, but the accused persons also abused and assaulted them and issued threats to kill. Based on the above facts and circumstances, a criminal case has been registered against the accused persons, including the applicant, for offences punishable under Sections 296, 126, 351(2), and 3(5) of the Bharatiya Nyaya Sanhita, 2023, as well as Sections 25 and 27 of the Arms Act, 1959. 3. The learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in the case. He further submits that there is no material in the hands of the prosecution to connect the applicant with the aforementioned crime. The applicant has not committed any offence and has been falsely implicated solely on account of his association as a friend of the co-accused, Mitesh Kenwat.
The co-accused, Mitesh Kenwat, has already been granted regular bail vide order dated 28.09.2025, passed by the Learned Chief Judicial Magistrate, Korba (C.G.), in Criminal Case No. 8709/2025. Hence, he prays for grant of anticipatory bail to the applicant. 3

On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and from perusal of the case diary, it transpires that on 28.09.2025 at approximately 12:45 AM, the applicant, along with co-accused persons, allegedly surrounded the complainant near Bhatia Store (in front of the ground), abused and assaulted him, and further, the applicant brandished a sharp-edged knife and extended a life threat to the complainant. It is respectfully submitted that from the perusal of the case diary, prima-facie involvement of the applicant in the commission of the alleged offence is clearly reflected. In the present matter, a specific and named allegation has been made against the applicant, in view of the seriousness of the allegations, it is prayed that the present anticipatory bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, the allegations levelled against the applicant, and from perusal of the records, it transpires that the applicant, along with co-accused persons, allegedly surrounded the complainant near Bhatia Store (in front of the ground), abused and assaulted him, and further, the applicant brandished a sharp-edged knife and extended a life threat to the complainant, further the involvement of the applicant in the commission of the alleged offence is clearly reflected and also considering the fact that a specific and named allegation has been made against the applicant, thus, in view of the seriousness of the
4 allegations, I am not inclined to grant anticipatory bail to the applicant. 7.

Accordingly, the Anticipatory Bail application of the applicant – Chandrapal Singh Sidar, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 595/2025, registered at Police Station – Civil Line Rampur, District- Korba (C.G.) for alleged commission of offence punishable under Sections 296, 126, 351(2), 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 25 and 27 of the Arms Act, is rejected.
