1. Heard Mr. Punit Ruparel, learned counsel for the petitioner. Also heard Mr. Praveen Das, learned Dy. Advocate General for the State/respondent/s as well as Mr. Venketesh Pandey, Advocate appearing on behalf of Mr. R.S, Marhas, learned counsel for the respondent No.3.
2. The only relief that petitioner seeks for in the present writ petition is for appropriate direction to the respondent No.3 to take into
consideration the request of the petitioner for taking necessary steps in conducting the election of the society in which the petitioner also is candidate for appointment as a President of Adim Jati Sewa Sahkari Samiti Maryadit, Wadrafnagar, Registration No.1142, District Balrampur-Ramanujganj.
3. The limited prayer is not opposed by the State counsel. However, he submits that there does not seem to be any document to show that petitioner has approached respondent No.3 in this regard. However, petitioner submits that he has already approached respondent No.2 and 4 vide Annexure P/4.
4. In view of the same, the writ petition as of now stands disposed of directing the petitioner to approach respondent No.3 afresh by way of a fresh representation and respondent No.3 in turn shall duly consider the same and take necessary steps in accordance
3 with the provisions of Section 49(8) of the Co-operative Societies Act at the earliest preferably within a period of 45 days from the date of receipt of the representation of the petitioner.
5. With the aforesaid observations and directions, the present writ petition is disposed of.
