Mr. Chandramauli Shah, learned counsel for the applicant. 2. Mr. Siddhartha Bisht, learned AGA along with Mr. Himanshu Sain, learned Brief Holder for the State. 3. Present applicant– Dinesh Singh Bisht S/o Nar Singh, is in judicial custody since 17.03.2025 and seeking regular bail in relation to FIR/Case Crime No.0100 of 2025, registered on the basis of FIR dated 14.03.2025 at Police Station Vikas Nagar, District Dehradun, which was lodged against Sagar and Himanshu Sharma and five unknown persons for the offences punishable under Section 324(2), 326(g) and 351(3) of BNS, 2023. 4. Learned counsel for the applicant submits that the applicant is innocent and, in fact, the complainant himself submits his affidavit on 21.03.2025 that the fire was caused due to a short circuit, the copy of which is enclosed at page No.18. Apart from this, he submits that the other co-accused, namely, Sagar, who was named in the FIR, has already been enlarged on bail by this Court on 24.04.2025. 5. On the other side, learned State counsel has not disputed about the affidavit filed by the complainant, however, he submits that the investigation is still going on. He has also not disputed this fact that the other co-accused, Sagar, has already been granted bail by this 2025:UHC:3348 Court on 24.04.2025. 6. After hearing the arguments, as advanced by learned counsel for the parties and further taking into consideration that the other co-accused Sagar has already been granted bail by this Court on 24.04.2025 in Bail Application No.676 of 2025, and, furthermore, the complainant, himself gave an affidavit on 21.03.2025 by giving reasons of the fire, this Court is of the view, that the present applicant deserves to be enlarged on bail. 7. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 8. Let the applicant, namely, Dinesh Singh Bisht, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
