C SUMON 4 The Court made the following: ORDER: This Contempt Case is filed under Sections 10 to 12 of Contempt of Courts Act, 1971, for the willful disobedience of the orders dated 11.09.2023 passed in W.P.No.34749 of 2022. 2. Learned counsel for the petitioner submitted that the respondents have paid the amount however there is some dispute with regard to the same. 3. On the other hand, learned counsel for the respondents submitted that the orders of this Court dated 11.09.2023 disobedience of which is complained of in this contempt case has been complied with and the respondents have paid the admitted amount to the petitioner. If at all the petitioner had any dispute with regard to the same, they have to approach competent forum claiming the same, as such, there is no willful disobedience as alleged by the petitioner and there remains nothing for adjudication and prayed to close the contempt. 4. Perused the record and considered the submissions. 5. The following is the order of this Court dated 11.09.2023 passed in W.P.No.34749 of 2022: “The learned counsel for the petitioner sought time to file a consolidated statement to show the supplies made under each agreement with supporting documents. The learned counsel for the petitioner further submitted that in the counter, the Executive Engineer, RWS & S Department, Adoni, has admitted that the petitioner is entitled for Rs.22,79,220/- as per the measurements recorded in M-Book and pending disposal of this Writ Petition, the authorities may be directed to pay the admitted/undisputed amount to the petitioner. In reply, the learned Assistant Government Pleader sought four (04) weeks time for payment of the admitted/undisputed amount. 5 In view of the above, the respondent authorities are directed to pay the admitted/undisputed amount of Rs.22,79,220/- to the petitioner within a period of four (04) weeks from today. Post on 09.10.2023.” 6. This Court directed the respondents to release the admitted amount of Rs.22,79,220/- to the petitioner. The counter would go to show that an amount of Rs.22,79,220/- and in addition to that an amount of Rs.14,35,328/- was also paid for subsequent bills to the petitioner. If at all the petitioner has any dispute or claim beyond what has been paid by the respondents, they have to approach competent forum with regard to the same. Therefore, there is no willful disobedience as alleged by the petitioner and the contempt is liable to be closed. 7. Accordingly, the Contempt Case is closed. There shall be no order as to costs.
