This is an application under Section 115 of the Code of Civil Procedure, 1908 (for short, “the CPC”), challenging the order dated 09.11.2023, whereby the suit of the petitioner, who is the plaintiff, being Title Suit No. 7/2015, was dismissed by the Court Page No.# 2/2 of the learned Civil Judge (Junior Division) No. 1, Tinsukia. The ground on which the suit was dismissed is that the plaintiff has not adduced any evidence. 3. This Court duly takes note that the pleadings are not proof and nothing could be shown that the defendants had admitted the case of the plaintiff. 4. Considering the above, this Court finds no error in exercise of jurisdiction by the learned Court of the Civil Judge (Junior Division) No. 1, Tinsukia, in its order dated 09.11.2023, for which the instant petition stands dismissed.
