1. This CRMP under Section 528 of the BNSS has been filed by the petitioners seeking quashment of the FIR dated 27/04/2024 bearing Crime No. 303/2024 at Police Station Baloda, District Baloda-Bazaar for offence under Section 420/34 of the IPC as also the proceeding arising out of the said FIR. 2. The present petition has been filed by the petitioners on the ground that the First Information Report registered against them is not only arbitrary and illegal, but is also an afterthought and fabricated in order to falsely implicate them who have no involvement much less any connection whatsoever in the alleged commission of offence punishable under Section 420 read with Section 34 of the Indian Penal Code. 3

This Court vide order dated 26/09/2025 directed the DGP to file his personal affidavit indicating as to why the investigation of the case has not yet been concluded despite the fact the FIR was registered on 27/04/2024. 4. Pursuant to the said order, the DGP filed his personal affidavit on 07/10/2025. Relevant portion reads as under:-
“2. That, it is respectfully submitted that, in view of the aforesaid direction of this Hon'ble Court, the following facts are submitted for kind consideration: (i) That, the accused persons in the present case are residents of different places, namely, Greater Noida, Delhi, Bhopal, and Gurugram, and their total number is seven. (ii) That, notices were issued to the complainant on several occasions, however, despite such notices, the complainant did not respond or cooperate with the investigation. The details of such notices are as under: • 28/04/2024 (Notice given under Section 91 Cr.PC. • 22/08/2024 (Telephonically) • 13/11/2024 (Telephonically) • 05/12/2024 (Telephonically) (iii) That, during the course of investigation, a police team visited New Delhi from 03/05/2025 to 04/05/2025 for the purpose of conducting necessary inquiry and verification. 3. That, after conducting a detailed and in-depth investigation, the police came to the conclusion that no offence was made out against the accused persons. Accordingly, a Closure Report was
4 prepared by the Station House Officer, Police Station Balodabazar, District Balodabazar-Bhatapara (C.G.), and the same was duly noted in the Case Diary on 31/12/2024. The said report was thereafter approved by the then Senior Superintendent of Police, Balodabazar-Bhatapara.
A copy of the Closure Report prepared by the Station House Officer, Police Station Balodabazar, District Balodabazar-Bhatapara (C.G.) dated 31/12/2024, is annexed herewith as ANNEXURE A-1. 4. Thereafter, the aforesaid Closure Report, prepared by the Station House Officer, Police Station Balodabazar, District Balodabazar-Bhatapara (C.G.), was submitted before the learned Chief Judicial Magistrate, Balodabazar-Bhatapara, which is presently pending consideration before the said Court. A copy of the general diary in which the Closure report has been submitted in the CJM Court, that is annexed herewith as ANNEXURE A-2. 5. That, the deponent most respectfully submit that Inspector General of Police Raipur, Range Raipur C.G. has submitted a report to the deponent. That, after considering all the aspects of the matter and the materials available on record and after due
consideration of the explanations submitted by the concerned Investigating Officers, and the SHO, the explanation was not found satisfactory. Hence, through the Office of the IGP Raipur, Range, Raipur vide his order dated 06-10-2025, investigation officer and the SHO were penalised. A report of the Inspector General of Police Raipur, Range Raipur C.G. herewith as ANNEXURE- A3

Upon perusal of the affidavit filed by the DGP, it is evident that after conducting the detailed investigation, the police came to the conclusion that no offence was made out against the accused and accordingly, a closure report was prepared and the same was submitted before the CJM, Baloda-Bazaar, Bhatarapara, wherein the same is pending for consideration.

6. In view of the aforesaid fact that a closure report has already been submitted before the CJM, Baloda-Bazaar, the present CRMP is disposed of. Sd/- Sd/- (Bibhu Datta Guru)
