The
learned counsel for the petitioners is not available. Ms. K Vijayeswari, learned Assistant Government Pleader represented the
learned counsel for the respondent No.2.
2. The present contempt case is filed alleging non-compliance of the order dated 12.09.2017 in W.P No.26059 of 2017.
3. While disposing of the said writ petition, the learned Judge of erstwhile Common High Court for the State of Telangana and State of Andhra Pradesh,
directed the respondent No.3/The Regional Deputy Director, Survey, Settlement and Land Records, Kakinada, East Godavari District, to examine the records of Assistant Director/District Survey and Land Records with reference to the service of notice in advance to the writ petitioners about conducting of the survey and take appropriate decision as warranted by law as to conducting of survey in the presence of the writ petitioners, in the event, if conclusion is arrived to the fact that there was no notice to the petitioners before conducting survey by the respondent No.4.
4. On 26.09.2018, the respondent No.2 filed a counter-affidavit duly setting out the relevant aspects with regard to the issuance of notice dated 03.03.2018 to the petitioners and others about conducting of survey in respect of the subject matter land and issuance of endorsement dated 16.07.2018 by way of registered post etc. No reply-affidavit is filed denying the said aspects including the averment that the orders dated 12.09.2017 were complied with.
5. In the aforementioned circumstances, this Contempt Case is closed. No costs. Miscellaneous petitions pending, if any, shall stand closed. __________________________
