This is the First bail application 昀椀led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 196/2025 registered at Police Station – Padmnabhpur, District – Durg (C.G.), for the o昀昀ence punishable under Sections 119(2), 109 and 3(5)of the Bhartiya Nyaya Sanhita, 2023 and Sections 25 and 27 of the Arms Act. 2. As per the prosecution story, on 17.06.2025 at around 4:30 AM, the brother of the complainant came home drenched in blood, and upon enquiry, he informed that while he was out for a morning walk, the accused persons demanded money from him for alcohol. 2 refused, the present applicant allegedly held his hands, and co-accused Vansh Joshi assaulted him with a knife. After completion of the investigation, the police have 昀椀led the charge sheet, and the knife is stated to have been seized from the co-accused. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He submits that the material collected by the prosecution does not satisfy the essential ingredients required to constitute the alleged o昀昀ences against the present applicant. It is submitted that neither the MLC report nor the query report supports the prosecution version, and no overt act has been attributed to the applicant apart from an alleged heated altercation with the victim. He further submits that the applicant is a young individual and has already spent more than two months in custody, and keeping him in custody for a longer period will cause undue hardship and prejudice to his family. He also submits that the present applicant has been in jail since 15.03.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular to the present applicant. 4.
On the other hand, the learned State Counsel opposes the bail application of the present applicant and submits that the applicant allegedly held the injured person's hands while co-accused Vansh Joshi assaulted him with a knife, causing grievous stab injuries. Therefore, the applicant is not entitled to the grant of regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the material available in the case diary, and further considering the fact that
3 the applicant allegedly held the injured person's hands while co-accused Vansh Joshi assaulted him with a knife, causing grievous stab injuries, therefore, this Court is of the opinion that it is not a 昀椀t case to enlarge the applicant on bail. 7. Accordingly, the 昀椀rst bail application of the applicant – Girdhar Kurre, involved in Crime No. 196/2025 registered at Police Station – Padmnabhpur, District – Durg (C.G.), for the o昀昀ence punishable under Sections 119(2), 109 and 3(5)of the Bhartiya Nyaya Sanhita, 2023 and Sections 25 and 27 of the Arms Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. O昀케ce is directed to send a certi昀椀ed copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
