ORDER:
The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 20231 by the Petitioner /Accused No.2 for granting of pre-arrest bail in connection with Crime No.203 of 2025 of Ananthapuramu III Town Police Station, Ananthapuram District, registered for the alleged

offences punishable under Sections 90(1), 105, 69 and 238 read with 3(5) of the Bharatiya Nyaya Sanhita, 20232. 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. As seen from the record, the deceased, by name Lavanya, was earlier working as Software Engineer. She was not feeling well. She often suffers from epilepsy. She got in relation with Accused No.1. Later, she got pregnancy. The Accused No.1 requested Accused No.2 to introduce any one for facilitate the termination of the pregnancy. Accused No.2/Petitioner introduced Accused No.3 who demanded Rs.40,000/- to carry out the procedure. While carrying out the procedure the Lavanya died. This Court, in Crl.P. No.9504 of 2025, by order dated 26.09.2025, disposed of the bail application, granting liberty to the petitioner to approach the learned Sessions Judge, and granted one week’s time, directing that until such time, the petitioner shall not be arrested. The petitioner is aged about 34 years. He has completed his law course and is yet to enroll as an advocate. He is presently working in an advocate’s office at Ananthapuram

Considering the facts and circumstances of the case, the gravity and nature of the allegations levelled against the Petitioner/Accused No.2, this Court is inclined to grant pre-arrest bail to the Petitioner/Accused No.2. 5. In the result, the Criminal Petition is allowed with the following conditions:

i. In the event of arrest of the Petitioner/Accused No.2 he shall be enlarged on bail subject to him executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii.
The Petitioner/Accused No.2 shall make himself available for investigation as and when required; iii. The Petitioner/Accused No.2 shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The Petitioner/Accused No.2 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner/Accused No.2 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioner/Accused No.2 shall surrender his passport, if any, to the investigating officer.
