Neutral Citation No. - 2025:AHC:71024-DB Court No. - 40 Case :- WRIT - C No. - 14137 of 2025 Petitioner :- R.C.J. Enterprises Respondent :- Rajkiya Nirman Nigam Ltd. And 2 Others Counsel for Petitioner :- Ayank Mishra Counsel for Respondent :- Vivek Saran Hon'ble Shekhar B. Saraf,J. Hon'ble Dr. Yogendra Kumar Srivastava,J.
1. Heard learned counsel appearing on behalf of the parties.
2. Learned counsel appearing on behalf of the petitioner submits that the tender that has been issued by respondent no.1 is discriminatory in the nature as it only allows the persons who are the registered contractors with the respondent no.1. The petitioner is not a registered contractor, and therefore, submits that this clause is discriminatory in nature.
3. In our view, nothing had prevented the petitioner to have complied with the rules of the respondent/corporation to get registered as a registered contractor with the corporation. Furthermore, we do not find this condition to be discriminatory in any manner as the corporation is required to follow certain mandates as per the several Government norms.
4. In light of the same, we are of the view that this writ petition is not maintainable, and is accordingly, disposed of granting liberty to the petitioner to make an application before the respondent no.1 for registering itself as a registered contractor as per the norms. If such an application is made within two weeks from date, the respondent authorities are directed to consider the same and pass a
reasoned order on the same.
5. We make it clear that the process pursuant to the the present bid that has been issued by the corporation/respondent no.2 shall continue and the order passed today in the Court shall not act as an impediment in tender process in any manner.
6. With the above directions, the writ petition is disposed of. Order Date :- 2.5.2025 Dev (Dr. Y. K. Srivastava,J.) (Shekhar B. Saraf,J.) Digitally signed by :- DEV PRAKASH High Court of Judicature at Allahabad
