1. This first anticipatory bail application under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.660/2025 registered at Police Station – Takhatpur AVINASH SHARMA Digitally signed by AVINASH SHARMA Date: 2025.12.04 17:55:12 +0530

The prosecution case in brief, is that, on 16.11.2025, applicant in his instagram story insulted hindu religion by saying that you people have called Ponga Pandit from Madhya Pradesh, you are blind devotees, you people eat cow dung and drink cow urine, do not send your future children to school for education, send them to temple to beg and feed them cow dung and make them drink cow urine.

Learned counsel for the applicant submits that the applicant is innocent and falsely implicated in this case. Learned counsel for the applicant submits that ingredients of alleged offence are not attracted against the applicant and the applicant had no intention of hurting religious sentiments. Learned counsel further submits that words of the applicant have been manipulated through artificial intelligence and thereby circulated on social media. Hence, he prays for grant of anticipatory bail to the present applicant.

On the other hand, learned counsel for the State opposes the bail application and submits that the applicant used a social media application namely ‘Instagram’ and used a feature thereof, which allows users of the app to post stories. Learned State counsel submits that applicant used the said feature and wrote some paragraphs using foul, filthy language to a serious extent.

Learned counsel further submits that applicant targeted the Hindu religion and said that the Hindu community is calling priest (Pandit) from the State of Madhya Pradesh, that the people from the said religion eat cow dung and cow urine and education is not important for them, applicant said that don’t send your children to school for education instead send them to temple to beg. Therefore, considering the backdrop, he is not entitled to be granted anticipatory bail.
5. I have heard learned counsel appearing for the parties and perused material available on record.

Taking into consideration the facts and circumstances of the case, submission of counsel for the parties, nature of allegation made against the present applicant and the foul and filthy language used by him against a community, this Court is of the view that it will be appropriate to reject the anticipatory bail of the present applicant.
7. Accordingly, the Anticipatory Bail application of applicant - Maghilal Banjare involved in Crime No.660/2025 registered at Police Station – Takhatpur District – Bilaspur (C.G.) for the offence punishable under Section 299 of Bharatiya Nyaya Sanhita, 2023., is rejected.
